1. About Onvira

Onvira is a digital agency registered in Kenya that provides services including website development, SEO, Google Maps registration, digital marketing, cybersecurity advice, and WhatsApp automation. These terms govern your use of our website and any services we provide to you.

2. Services

When you engage Onvira for a service, the specific scope of work, deliverables, timelines, and payment terms will be agreed in writing — either through a formal contract or written proposal — before work begins.

We reserve the right to decline to take on any project at our discretion. Acceptance of an enquiry through this website does not constitute a binding contract; a contract is only formed when both parties have agreed to a written scope and terms.

3. Payment

Payment terms will be specified in your service agreement. Generally:

• A deposit is required before work commences
• Final payment is due upon delivery of the agreed deliverables
• Late payments may incur a delay in project delivery
• All prices are quoted in Kenyan Shillings (KES) unless otherwise agreed

We accept payment via M-Pesa, bank transfer, and other methods as agreed. Receipts will be provided for all payments.

4. Client responsibilities

To deliver quality work on time, we rely on you to:

• Provide accurate and complete information about your business and requirements
• Respond to our requests for content, feedback, or approvals within agreed timeframes
• Ensure you have the rights to any content (images, text, logos) you provide to us
• Nominate a point of contact who has authority to approve decisions

Delays caused by the client's failure to provide required inputs may result in revised timelines, for which Onvira will not be held responsible.

5. Intellectual property

Upon full payment, you own the final deliverables created specifically for your project (such as your website design and content). Onvira retains ownership of any tools, frameworks, templates, or processes used to build those deliverables.

You grant Onvira the right to display completed work in our portfolio unless you request otherwise in writing.

6. Confidentiality

Both parties agree to keep confidential any sensitive business information shared during the course of the engagement. We will not share your business information with third parties except as required to deliver the agreed services (e.g. hosting providers, platform partners).

7. Limitation of liability

Onvira will perform all services with reasonable skill and care. However, we cannot guarantee specific outcomes such as Google rankings, number of website visitors, or business revenue — as these depend on many factors outside our control.

Our liability for any claim arising from our services shall not exceed the total amount paid by the client for the specific service in question.

8. Third-party platforms

Some of our services involve third-party platforms (Google, Meta, WhatsApp, Jotform, etc.). These platforms have their own terms of service and we are not responsible for any changes they make to their policies, features, or availability.

9. Termination

Either party may terminate a service agreement with written notice. Work completed up to the point of termination will be invoiced at the agreed rate. Deposits are non-refundable unless Onvira fails to commence work within the agreed timeline.

10. Governing law

These terms are governed by the laws of Kenya. Any disputes arising will be subject to the jurisdiction of Kenyan courts. We always prefer to resolve disputes amicably — please contact us first if you have a concern.

11. Changes to these terms

We may update these terms from time to time. The most current version will always be available on this page. Continued use of our website or services after an update constitutes acceptance of the revised terms.
